Terms and Conditions:
Ferry service provided by Block Island Express is subject to the following terms and conditions, in addition to any terms and conditions printed on any ticket, or posted on Block Island Express’s website. To the extent there is a conflict between these Terms & Conditions and those printed on any ticket or posted on Block Island Express’s website, the following Terms & Conditions shall govern. By purchasing a ticket or accepting ferry transportation, the customer agrees to be bound by all of the following Terms & Conditions:
COVID-19: We have taken the enhanced health and safety measures recommended by governmental agencies for you, our other passengers, and our employees. You must follow all posted instructions while traveling with Block Island Ferry Services. Despite this, an inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and people with underlying medical conditions are especially vulnerable. By traveling with Block Island Ferry Services, passengers voluntarily assume any and all risks related to exposure to COVID-19, whether or not it is alleged that the Company contributed, in whole or in part, to the risk or otherwise was responsible in any way for it.
Arrive Early: It is strongly recommended that you arrive at our ferry dock at least thirty (30) minutes in advance of scheduled departure time. Please allow ample time for unanticipated traffic delays, parking, issuance of tickets and boarding the ferry.
Tickets are not sold or issued on any of the ferries.
10 Minute Rule: Tickets must be issued ten (10) minutes prior to your scheduled sailing time or your reservation will be cancelled and you will be placed on standby. NO EXCEPTIONS WILL BE MADE TO THIS RULE.
Priority Service: Priority Reservations that are checked in, ticketed, and ready to board at least 30 minutes prior to departure time will be in the first boarding group. Because vessel boarding may begin as early as 30 minutes prior to departure, Priority Service reservations that are checked in and ready to board between 30 minutes and 5 minutes prior to departure will be boarded as soon as practicable. Priority Service reservations may check in until 5 minutes before departure time, after which your reservation may be cancelled and you may be placed on standby. Priority Reservations may be changed without a processing fee, but the changes must be made prior to the reserved date and time of departure. Cancellation fees still apply.
Reservations: Your reservation confirmation and a photo ID, must be presented at our ticket office in order for tickets to be issued.
Accessibility: Guidance for disabled passengers and passengers needing assistance is available on our website and in our ticket offices. Please notify our personnel of any accessibility requirements upon arrival at our terminal and prior to boarding the vessel.
Unaccompanied Minors: Block Island Express reserves the right not to accept any passenger under the age of 18 years, unless accompanied by an adult.
Pets: Pets allowed in approved pet carriers only -- no leashes. Pets must remain in their carriers for the duration of the trip.
Customer Safety: Customers shall at all times follow and carry out all lawful directions of the Captain, the Mate and/or crew members of the vessel, particularly in relation to (but not limited to) personal safety of themselves, the crew, or other passengers.
Security: All passengers, baggage, personal items and freight may be subject to search and inspection prior to boarding and at anytime while onboard the ferry. Customers who refuse to consent to a search may be denied passage. In accordance with Department of Homeland Security Regulations, intoxicated or disorderly persons are considered security risks and will be denied passage and/or arrested. Block Island Express reserves the right to deny passage to anyone it deems a safety or security risk. No dangerous goods/cargo or firearms may be brought on board without the permission of Cross Sound. If in doubt as to whether items qualify as dangerous goods, please ask us before travel or boarding may be refused.
Customer Cancellation Policy: Refunds will be issued, minus a $2.00 processing fee per ticket, per direction, for cancellations made two or more calendar days prior to sailing date. For cancellations made less than two calendar days prior to sailing date, refunds will be issued, minus a $4.00 processing fee per ticket, per direction. Unused reservations or those not cancelled prior to departure time will be subject to forfeiture of the entire amount. Customers must contact the Block Island Express ticket office before their reservation departure time for any changes, refunds, or credits. Refunds will not be issued after the date and time of departure. At the close of each season, when the last scheduled departure leaves Block Island, any unused reservations or tickets are subject to forfeiture of the entire amount. Reservations are non-transferable.
Change Policy: Changes to departure dates or times made at least two calendar days prior to sailing date, are allowed without a processing fee. Changes to departure dates or times made less than two calendar days prior to sailing date are allowed, minus a $2.00 processing fee per ticket, per direction. No changes will be allowed after the date and time of departure. Reservations are non-transferable. Fares are subject to change and Block Island Express reserves the right to re-price a reservation that is changed after it was originally booked.
Delays or Cancellation: Block Island Express does not guarantee that the ferry will depart or arrive at the time stated on the schedule and crossing times may vary. Block Island Express at its sole and absolute discretion, reserves the right to change or cancel any scheduled trip and/or substitute a vessel without notice or liability. If a trip is cancelled by Block Island Express, tickets may be fully refunded or exchanged for a different trip, subject to availability. Block Island Express will not be responsible for any additional expenses incurred by a customer as a result of any change, delay or cancellation.

Choice of Law, Forum Selection, Venue:This agreement and any claims related to passengers shall be controlled by the law of Rhode Island without regard to its conflict of laws principles. Any suit or action arising out of or relating to this agreement or passage on the vessel including claims for personal injury or death shall only be instituted in a State or Federal court in Connecticut. Each passenger agrees to personal jurisdiction of either such court and waives any objection he/she may have to venue therein.
Limitations: Block Island Express’s liability for loss or damage to vehicle or personal property is limited to $1,000. Block Island Express shall not liable for any loss or damage to personal property or for personal injuries, illness or death, unless written notice is given to Block Island Express within 6 months of the date of the occurrence, and suits on all such claims shall not be maintainable unless filed within 1 year after the date of the injury, event, illness or death. Limitations on liability for claims based on exposure to COVID -19 are set forth in the COVID-19 paragraph above.
Severability: If any provision herein shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby and shall remain valid, legal and enforceable to the fullest extent permitted by law.
